1.1. The SnowBuzz application, the SnowBuzz website, and every related service, feature, interface, or system are operated by Yaakov Rahamim (the “Operator”).
1.2. In these Terms of Use, the SnowBuzz application, website, administrative interfaces, Content, services, and features offered through them are collectively referred to as “SnowBuzz,” the “System,” or the “Service.”
1.3. These Terms of Use govern access to and use of the System by any person who views Content, opens an account, publishes Content, communicates with other Users, uses the Ski Tracker, finds skiing or snowboarding partners, finds Instructors, operates an Instructor profile, or otherwise uses the System (the “User”).
1.4. Downloading, installing, registering, signing in, viewing Content, or otherwise using the System confirms that the User has read these Terms of Use, understood them, and agreed to be bound by them.
1.5. A User who does not agree to all or part of these Terms of Use may not use the System.
1.6. Use of the System is also subject to the following documents, which form an integral part of these Terms of Use:
SnowBuzz’s Privacy Policy.
SnowBuzz’s Community Guidelines.
The “Ski Partners” Terms, when that Service is used.
The Ski and Snowboard Instructor Service Terms, when that Service is used.
Additional terms displayed in relation to a particular feature, subscription, or Service.
1.7. In the event of a conflict between these Terms of Use and specific terms applying to a particular Service, the specific terms shall prevail solely in relation to that Service.
1.8. Section headings are provided for convenience only and shall not be used to interpret these Terms of Use.
1.9. References in the singular include the plural, and vice versa. Any gendered language is used for convenience only and applies to all genders.
2.1. The System may be used by a User who is at least 13 years old, or a higher age where that is the minimum age required by the law applicable in the User’s place of residence.
2.2. A User who has not reached the age of majority in their place of residence must obtain the consent of a parent or legal guardian before using the System.
2.3. A parent or guardian who allows a minor to use the System is responsible for reviewing these Terms, explaining them to the minor, and supervising use according to the minor’s age, abilities, and the risks associated with the Service.
2.4. Certain features, including arranging meetings, engaging an Instructor, purchasing a subscription, or sharing location, may be limited to Users who have reached a particular age or may require the consent, involvement, or supervision of a parent or guardian.
2.5. SnowBuzz may restrict or block an account where there is a reasonable concern that the User does not meet the age requirements, uses the System in a manner unsuitable for their age, or uses the System in a way that may endanger the User or another person.
3.1. SnowBuzz is a technology platform relating to skiing, snowboarding, and snow activities.
3.2. The System may allow Users, among other things, to:
View news, updates, and information relating to skiing and snowboarding.
View information concerning ski resorts, routes, lifts, skiing or snowboarding conditions, cameras, weather, and snow.
Publish posts, comments, questions, answers, and field reports.
Participate in chats and groups.
Find skiing or snowboarding partners.
Create and manage partner groups.
Share location with group members where the option is enabled.
Find and contact ski and snowboard Instructors.
Open an Instructor profile.
Submit Lesson Requests and manage availability.
Use the Ski Tracker and record skiing or snowboarding routes.
Plan a holiday and manage lists and expenses.
Receive notifications and updates.
Purchase subscriptions or digital features.
Use additional services that may be added from time to time.
3.3. SnowBuzz may add, change, restrict, or remove features, screens, usage options, or types of Content at its discretion and subject to applicable law.
3.4. The availability of a feature in a particular country, device, operating system, application version, or for a particular type of User does not guarantee that it will be available everywhere or to every User.
3.5. SnowBuzz is not a ski resort, travel company, transportation company, insurance company, emergency service, ski school, Instructor agency, or organiser of holidays or meetings.
3.6. Unless expressly stated otherwise, SnowBuzz provides only a technology platform for displaying information, publishing Content, and facilitating contact.
4.1. Use of some System features may require the User to open an account.
4.2. When opening an account, the User undertakes to provide correct, complete, accurate, and current information.
4.3. A User may not open an account in another person’s name, impersonate another person, or provide false or misleading details.
4.4. SnowBuzz may limit the number of accounts a User may open and prevent the creation of duplicate, false, or circumvention accounts.
4.5. The User is responsible for maintaining the confidentiality of the means used to access the account and for all activity performed through the account, unless the activity resulted from a failure for which SnowBuzz is responsible and whose liability cannot be limited under applicable law.
4.6. The User undertakes not to transfer, sell, or rent the account, share a password, or allow another person to use the account in breach of these Terms.
4.7. If unauthorised use of the account is suspected, the User should change the login details and notify SnowBuzz as soon as possible.
4.8. SnowBuzz may ask the User to verify details, an email address, telephone number, identity, or other information where required for security, fraud prevention, use of a particular feature, or compliance with applicable law.
4.9. Verification of an account or particular detail does not constitute a commitment that all User information is correct and does not constitute a recommendation, approval, or guarantee of the User’s conduct.
4.10. The User may stop using the System or request deletion of the account through the relevant option in the System or by using the method described in the Privacy Policy.
4.11. Deleting an account does not automatically cancel a subscription purchased through an application store. Such a subscription must also be managed or cancelled through the relevant application-store account.
4.12. Certain information or Content may be retained after an account is closed where required for security, preserving the integrity of discussions, handling reports, preventing fraud, complying with legal requirements, or protecting legal rights, in accordance with the Privacy Policy.
5.1. Subject to the User’s compliance with these Terms, SnowBuzz grants the User a limited, personal, non-exclusive, revocable, and non-transferable licence to use the System for its intended purposes.
5.2. The licence does not grant the User any ownership right in the System, software, code, design, information, databases, or any other SnowBuzz component.
5.3. Personal use of the System is permitted for private and community purposes. Business or commercial use is permitted only through features intended for that purpose or after obtaining SnowBuzz’s express approval.
5.4. Instructors, businesses, advertisers, and service providers may use the System only in accordance with the specific terms applicable to them.
5.5. SnowBuzz may revoke the licence to use the System in the event of a breach of these Terms, a violation of law, harm to Users, harm to the System, or use outside the Service’s intended purposes.
6.1. The System may allow the User to publish or transmit text, messages, posts, comments, questions, answers, images, videos, documents, reviews, ratings, links, profile details, route data, or other Content (“User Content”).
6.2. The User retains ownership of the rights in User Content that the User created and uploaded, to the extent those rights belong to the User.
6.3. Uploading Content does not transfer ownership of it to SnowBuzz.
6.4. The User grants SnowBuzz a limited, non-exclusive, royalty-free licence to store, copy, technically process, adapt, display, distribute within the Service, and make User Content accessible to the extent required for:
Operating the System.
Displaying the Content to relevant Users.
Storage and backup.
Adaptation to different devices and formats.
Handling reports.
Security and prevention of misuse.
Technical support.
Improving the Service.
6.5. SnowBuzz will not use a User’s image, an Instructor’s image, or personal Content in external advertising that identifies that User unless appropriate consent has been given or another lawful basis permits the use.
6.6. The licence to Content will generally end when the Content is deleted from the System, except for copies retained temporarily or on a limited basis for backup, security, recordkeeping, complaint handling, compliance with legal requirements, or protection of legal rights.
6.7. The User represents and undertakes that:
The User holds the required rights in the Content.
The Content does not infringe copyright, privacy, trademarks, or other rights.
The Content is not false, misleading, unlawful, or harmful.
Publishing the Content does not breach an obligation of confidentiality.
Where another person appears in the Content, appropriate permission for publication has been obtained where required.
6.8. The User is solely responsible for the Content published and the consequences of publication.
6.9. SnowBuzz is not required to review, approve, or verify every item of Content before publication.
6.10. SnowBuzz may remove, hide, restrict, technically edit, or refuse to publish Content where there is concern that it breaches these Terms, the Community Guidelines, applicable law, or another person’s rights.
6.11. The existence of filtering, monitoring, or moderation tools does not impose an obligation on SnowBuzz to detect or prevent every prohibited item of Content.
6.12. The User understands that published Content may be saved, photographed, copied, or transferred by other Users outside SnowBuzz’s control.
6.13. A User should not publish Content that the User does not wish to be disclosed to other Users under the Service’s display settings.
6.14. SnowBuzz does not undertake to retain User Content permanently, and the User should keep an independent copy of Content that is important to the User.
7.1. The User undertakes to use the System lawfully, reasonably, safely, and respectfully.
7.2. All use of the Content and communication features is subject to the SnowBuzz Community Guidelines.
7.3. Without limiting the Community Guidelines, the System may not be used for:
Harassment, threats, humiliation, bullying, or repeated unwanted contact.
Impersonating a person, Instructor, business, ski resort, or SnowBuzz representative.
Publishing false, misleading, harmful, or unlawful Content.
Fraud, fraudulent collection of money, or misrepresentation.
Publishing another person’s personal, sensitive, or confidential information without authorisation.
Infringing copyright, privacy, trademarks, or other rights.
Publishing spam, advertisements, or commercial offers without permission.
Using the Service for a purpose not reasonably related to skiing, snowboarding, or the features offered.
Encouraging unlawful or dangerous conduct.
Exploiting, harming, or making inappropriate contact with minors.
Circumventing a block, restriction, suspension, or safety mechanism.
7.4. The following may not be performed through the System:
Hacking or attempted unauthorised access.
Use of bots, scraping, or automated collection tools without permission.
Data mining or creation of a User database.
Reverse engineering, disassembly, or attempts to extract source code.
Distribution of malicious code, viruses, or harmful files.
Creating artificial loads or interfering with server operation.
Circumventing security mechanisms, usage limits, or permissions.
Copying, selling, renting, or commercially exploiting the Service.
Using System information for unauthorised marketing communication with Users.
7.5. SnowBuzz may impose reasonable usage limits, including limits on messages, publications, requests, searches, or actions within a particular period.
8.1. A User who encounters abusive, harassing, misleading, dangerous, or unlawful Content or conduct is requested to use the reporting tools available through the System.
8.2. Where a blocking option is available, the User may block another User to limit communication or exposure to that User’s Content, according to the operation of the System.
8.3. SnowBuzz may, but is not required to:
Review a report.
Request additional information.
Remove or hide Content.
Restrict communication.
Remove a rating or review.
Suspend or block an account.
Remove an Instructor profile.
Remove a verification designation.
Retain information for review purposes.
Report the matter to a competent authority where required or permitted by applicable law.
8.4. SnowBuzz does not undertake to provide the User with all details of an investigation, the identity of the reporting person, or information that may prejudice privacy, security, or the review process.
8.5. Reporting a matter to SnowBuzz does not replace contacting emergency services, the ski resort, a law-enforcement authority, a public authority, or another professional body where such contact is required.
8.6. Failure to take action in a particular case does not constitute approval of the Content or a waiver of the right to take action in the future.
9.1. All rights in the System, including the code, software, design, interfaces, the SnowBuzz name, trademarks, logo, graphics, databases, structure, arrangement, and SnowBuzz’s original Content, belong to the Operator or are used by the Operator under licence.
9.2. SnowBuzz components may not be copied, reproduced, published, distributed, sold, transferred, made available to the public, used to create derivative works, or used commercially without express authorisation.
9.3. Rights in Content belonging to Users, Instructors, advertisers, ski resorts, information providers, or other third parties remain with the relevant rights holders.
9.4. The appearance of third-party Content in the System does not grant the User a right to use it outside the purposes of the Service.
9.5. A User who believes that Content in the System infringes the User’s rights may submit a request containing sufficient information to identify the Content, the claimed right, and the person making the request, using the contact details displayed at the bottom of the page.
9.6. A suggestion, feedback, idea, or recommendation voluntarily provided by a User concerning improvement of SnowBuzz does not require SnowBuzz to implement it or pay for it. SnowBuzz may use feedback to develop and improve the Service without unnecessarily disclosing personal information.
10.1. SnowBuzz may display information originating from Users, ski resorts, weather providers, news websites, cameras, map systems, Instructors, advertisers, or other external sources.
10.2. This information may include, among other things:
Route and lift status.
Skiing or snowboarding congestion.
Weather and snow forecasts.
Temperatures and wind conditions.
Avalanche and risk reports.
Prices and operating hours.
Maps and access routes.
User reports.
News and updates.
Information concerning Instructors and services.
10.3. SnowBuzz does not guarantee that the information is correct, complete, accurate, continuous, or updated in real time.
10.4. Information may change without notice, be affected by a technical malfunction, or remain displayed after the actual circumstances have changed.
10.5. SnowBuzz must not be relied upon as the sole source for a safety, medical, professional, transportation, or financial decision.
10.6. Before participating in skiing, snowboarding, or another activity, the User should verify material information with official sources, ski-resort management, safety authorities, weather services, a qualified Instructor, or another appropriate professional body.
10.7. The appearance of information, a business, Instructor, link, product, or service in the System does not constitute a recommendation, approval, sponsorship, or guarantee by SnowBuzz.
11.1. Skiing, snowboarding, and snow activities involve inherent risks, including falls, collisions, injury, changing snow conditions, extreme weather, avalanches, loss of direction, equipment failure, and harm to persons or property.
11.2. The User is responsible for:
Acting according to the User’s ability and experience.
Following ski-resort instructions and signs.
Checking route and weather conditions.
Using suitable equipment in proper condition.
Assessing the User’s health and physical condition.
Avoiding closed or prohibited areas.
Obtaining appropriate instruction where required.
Holding appropriate insurance where required or recommended.
Complying with applicable law and local safety rules.
11.3. SnowBuzz is not a rescue, location, or emergency service.
11.4. In an emergency, the User must not rely on a chat, notification, location-sharing feature, Ski Tracker, or any other SnowBuzz feature. The User should immediately contact the emergency services, ski patrol, or the appropriate official authority at the location.
11.5. The System must not be used in a manner that causes distraction while skiing, snowboarding, driving, operating a vehicle, using a lift, or performing another activity requiring full attention.
11.6. The User is responsible for stopping in a safe place before viewing a screen, writing a message, changing a setting, or performing another action on the device.
12.1. SnowBuzz may offer a Ski Tracker feature that records location, route, distance, speed, altitude, activity time, and other metrics.
12.2. The metrics are based on device data, GPS, sensors, algorithmic calculations, and other technological sources.
12.3. The data may be inaccurate, incomplete, delayed, or affected by reception conditions, weather, mountainous terrain, battery level, permissions, device model, or technological limitations.
12.4. Speed, altitude, route, or location data must not be used as official evidence, as the sole means of navigation, as a rescue tool, or as a substitute for safety equipment.
12.5. The Ski Tracker is activated at the User’s initiative. Background location collection will occur only in accordance with the permissions granted and the operation described in the System and Privacy Policy.
12.6. The User is responsible for verifying that use of the feature is permitted in the User’s location and does not breach ski-resort instructions, local law, or another person’s rights.
12.7. SnowBuzz does not guarantee that every activity will be saved, synchronised, or recoverable.
12.8. Complete details concerning the collection, retention, and deletion of location data are set out in the Privacy Policy.
13.1. The “Ski Partners” Service is intended to allow Users to publish requests, join groups, make contact, and independently coordinate activities relating to skiing or snowboarding.
13.2. SnowBuzz is solely a connection platform and does not organise, manage, approve, or supervise meetings, trips, holidays, or shared activities.
13.3. SnowBuzz does not undertake to verify Users’ identities, skiing or snowboarding levels, experience, health, reliability, intentions, or suitability for a meeting.
13.4. Every contact, meeting, trip, sharing of costs, accommodation arrangement, or shared activity is arranged directly between the Users and at their responsibility.
13.5. The User is responsible for exercising judgment, checking the identity of the other party, and avoiding unnecessary disclosure of personal or sensitive information.
13.6. The Service may allow a User to share the User’s own location with members of a particular group. Location sharing begins only after an active step by the User and in accordance with the User’s permissions.
13.7. The location of another person may not be shared without that person’s permission.
13.8. The complete and specific terms applicable to the Service are set out in the “Ski Partners” Terms, which apply in addition to these Terms of Use.
14.1. SnowBuzz may allow Users to view Instructor profiles, submit Lesson Requests, and contact Instructors.
14.2. SnowBuzz is not a ski school and does not provide ski or snowboard Lessons.
14.3. Instructors are not SnowBuzz employees, agents, representatives, or partners.
14.4. Displaying an Instructor, profile, document, rating, price, or verification designation does not constitute a recommendation, professional approval, or guarantee by SnowBuzz.
14.5. The User is responsible for verifying directly with the Instructor the Instructor’s identity, training, licences, insurance, experience, prices, cancellation terms, and suitability.
14.6. Every Lesson, payment, cancellation, refund, or other arrangement is made directly between the User and the Instructor, unless SnowBuzz expressly announces a different Service.
14.7. The complete and specific terms applicable to the Service are set out in the Ski and Snowboard Instructor Service Terms, which apply in addition to these Terms of Use.
15.1. SnowBuzz may offer subscriptions, paid features, or digital services.
15.2. In-app purchases may be completed through the Apple App Store, Google Play, or another authorised provider.
15.3. The price, currency, taxes, subscription period, and billing terms will be displayed to the User before purchase approval through the relevant store or provider.
15.4. The displayed price may vary according to country, currency, taxes, exchange rates, store policies, or price updates.
15.5. In the case of a recurring subscription, the subscription may renew automatically in accordance with the terms displayed by the store unless it is cancelled through the store-account settings before the renewal date.
15.6. A subscription purchased through an application store must be managed, changed, or cancelled through the account with the relevant store.
15.7. Deleting the application from a device or discontinuing its use does not automatically cancel a subscription.
15.8. Refund requests concerning a purchase processed by an application store are subject to that store’s policy and applicable law.
15.9. SnowBuzz may change the prices of subscriptions or services in the future, but a change shall not apply to a period already paid for unless permitted under the store’s terms and applicable law.
15.10. Payment for an Instructor subscription does not guarantee a particular number of inquiries, bookings, students, revenue, views, or a particular rating.
15.11. Unless expressly stated otherwise, SnowBuzz does not process payment for Lessons between Users and Instructors and does not hold funds on their behalf.
16.1. The System may display advertisements, marketing Content, links, and services belonging to third parties.
16.2. SnowBuzz may use third-party services for, among other things:
Account sign-in.
Storage and cloud services.
Maps and location.
Delivery of notifications.
Usage analysis.
Advertising.
Verification of purchases.
Error reporting.
Display of external Content.
16.3. Use of third-party services may be subject to those parties’ terms and privacy policies.
16.4. SnowBuzz does not fully control third-party services and does not guarantee their availability, security, Content, or continued operation.
16.5. The appearance of an advertisement, link, product, or service does not constitute a recommendation or approval by SnowBuzz.
16.6. Every arrangement between a User and an advertiser or external provider is made directly between them unless expressly stated otherwise.
17.1. Personal information shall be collected, retained, and used in accordance with the SnowBuzz Privacy Policy and applicable law.
17.2. Use of certain features may require device permissions, including access to location, camera, photographs, notifications, or sensors.
17.3. The User may manage permissions through the device settings, but disabling a permission may prevent a particular feature from operating fully.
17.4. Personal, sensitive, medical, financial, or identifying information that is unnecessary for use of the Service should not be provided through the System.
17.5. Another person’s personal information or location may not be published without permission or an appropriate lawful basis.
17.6. SnowBuzz may disclose information to a competent public, judicial, regulatory, or law-enforcement authority where disclosure is required or permitted by applicable law.
17.7. Information may be stored or processed in countries other than the User’s country of residence, in accordance with the Privacy Policy and applicable safeguards.
18.1. The System is provided “AS IS” and “AS AVAILABLE.”
18.2. SnowBuzz does not guarantee that the System will operate at all times without interruptions, delays, errors, or information loss.
18.3. Disruptions may occur because of:
Maintenance work.
Software updates.
Heavy usage.
Communication failures.
Server failures.
Failures of third-party services.
Device settings.
Events outside SnowBuzz’s control.
18.4. SnowBuzz may correct, change, restrict, suspend, or discontinue a feature or Service, in whole or in part.
18.5. Where a change concerns a prepaid Service, SnowBuzz will act subject to the purchase terms, the store’s obligations, and mandatory rights under applicable law.
18.6. The User must not rely on SnowBuzz as the sole means of retaining important information, urgent coordination, navigation, or emergency contact.
19.1. SnowBuzz may restrict, suspend, or close an account where there is a reasonable concern regarding:
A breach of these Terms of Use.
A breach of the Community Guidelines.
A violation of law.
Fraud or impersonation.
Harm to another User.
Harm to a minor.
Harm to the System or its security.
Circumvention of a block.
Provision of false information or a false document.
Activity that may expose SnowBuzz or Users to risk.
19.2. SnowBuzz may take immediate action without prior notice where there is a concern regarding safety, fraud, privacy harm, harm to a minor, a violation of law, or harm to systems.
19.3. In other cases, SnowBuzz may, at its discretion, provide notice or allow the User to submit an explanation before or after action is taken.
19.4. SnowBuzz is not required to conduct a judicial or formal proceeding before taking enforcement measures.
19.5. A User whose account has been blocked may not open another account to circumvent the block.
19.6. Closing an account does not cancel rights, obligations, payments, or arrangements previously created between the User and other parties.
19.7. Provisions that by their nature are intended to continue after use ends shall remain in force, including provisions concerning Content, intellectual property, liability, indemnification, and disputes.
20.1. The provisions of this section shall apply to the fullest extent permitted by applicable law.
20.2. Nothing in these Terms excludes or limits any liability of SnowBuzz that cannot lawfully be excluded or limited.
20.3. SnowBuzz is not responsible for Content published by Users, Instructors, advertisers, ski resorts, information providers, or other third parties.
20.4. SnowBuzz is not responsible for the conduct, identity, reliability, intentions, abilities, licences, insurance, or health of any User or Instructor.
20.5. SnowBuzz is not responsible for any contact, agreement, payment, meeting, Lesson, trip, holiday, sharing of costs, or dispute between Users or between a User and an Instructor.
20.6. SnowBuzz is not responsible for damage arising from:
Reliance on incorrect, incomplete, or outdated information.
Weather, snow, or route conditions.
A skiing, snowboarding, or snow-activity accident.
Use of the Ski Tracker or GPS data.
Location sharing or inaccurate location data.
Loss of Content or information.
Failure to receive a message or notification.
A malfunction or interruption of the Service.
An act or omission of a third party.
Unauthorised access that does not result from a breach of an obligation whose liability cannot be limited under applicable law.
20.7. To the fullest extent permitted by applicable law, SnowBuzz shall not be liable for indirect, consequential, special, or incidental loss, including loss of profit, revenue, information, opportunity, holiday time, or reputation.
20.8. Where SnowBuzz is found liable and that liability cannot be excluded, its aggregate liability shall not exceed the greater of:
The amount paid directly to SnowBuzz by the User during the 12 months preceding the event giving rise to liability; or
Any other minimum amount required by applicable law.
20.9. The limitation of liability shall not apply to intentional misconduct, fraud, or any other liability that applicable law does not permit to be limited.
21.1. Subject to applicable law, a User who breaches these Terms or acts contrary to law shall indemnify SnowBuzz, the Operator, and anyone acting on their behalf for any damage, claim, demand, loss, or reasonable expense directly resulting from the breach.
21.2. Indemnification may apply, among other things, in the event of:
Unlawful Content or Content that infringes rights.
Provision of false information.
Impersonation or fraud.
Violation of another person’s privacy.
Unauthorised commercial use.
Harm to the System.
Conduct resulting in a claim by a User, Instructor, authority, or third party.
21.3. The indemnification may include reasonable legal expenses actually incurred, to the extent permitted by applicable law.
21.4. SnowBuzz will notify the User of a material claim within a reasonable time where reasonably possible and where doing so does not prejudice SnowBuzz’s rights or the review process.
21.5. This section shall not apply to damage caused by an act of SnowBuzz for which liability cannot be limited under applicable law.
22.1. SnowBuzz may update these Terms from time to time, including because of changes to the System, technology, business model, application-store requirements, or applicable law.
22.2. The date of the latest update will be displayed at the beginning of the document.
22.3. In the event of a material change, SnowBuzz may provide notice through the application, by email, or through another appropriate method.
22.4. Continued use of the System after the updated Terms take effect constitutes acceptance of them, subject to rights that cannot be waived under applicable law.
22.5. A change shall not apply retroactively where retroactive application is prohibited under applicable law or would prejudice a right completed before the change.
22.6. A User who does not agree to the updated Terms must stop using the System.
23.1. These Terms of Use and use of the System shall be subject to applicable law.
23.2. Nothing in these Terms derogates from a consumer right, privacy right, or other right that cannot be waived under the law applicable in the User’s place of residence.
23.3. A dispute relating to the System or these Terms shall be heard by a court, authority, or competent body in accordance with applicable law and mandatory jurisdiction rules.
23.4. Nothing in these Terms prevents a User from contacting a consumer authority, data-protection authority, law-enforcement authority, or other competent body where the User has a right to do so.
23.5. Before commencing legal proceedings, the parties are requested to attempt to resolve the dispute in good faith through an orderly written request, unless prior contact is not required, is inappropriate, or may prejudice the rights of the party making the request.
24.1. These Terms of Use and the documents incorporated into them constitute the agreement between the User and SnowBuzz concerning use of the System.
24.2. If any provision is found to be unlawful, invalid, or unenforceable, it shall be interpreted or limited to the extent required, and the remaining provisions shall continue in full force and effect.
24.3. SnowBuzz’s failure to enforce a right in a particular case does not constitute a waiver of that right.
24.4. The User may not transfer rights or obligations under these Terms without SnowBuzz’s consent, to the extent such a restriction is permitted under applicable law.
24.5. SnowBuzz may transfer operation of the Service, its rights, or its obligations to another entity as part of a sale of business operations, merger, restructuring, or asset transfer, subject to applicable law and continued protection of Users’ rights.
24.6. SnowBuzz shall not be regarded as breaching an obligation because of an event outside its reasonable control, including a natural disaster, extreme weather, war, pandemic, strike, shutdown, nationwide outage, large-scale cyberattack, or discontinuation of an essential supplier’s service.
24.7. Notices relating to the System may be provided through the application, by email, through Push Notifications, or through another means of communication provided by the User.
24.8. Translated versions of these Terms may be offered for Users’ convenience. The English version shall be the controlling version in the event of an inconsistency between versions, unless applicable law requires otherwise.
25.1. By using the System, the User confirms that the User has read these Terms of Use, understood them, and agreed to comply with them.
25.2. Use of a specific Service also constitutes acceptance of the specific terms applicable to that Service.
25.3. A User who does not agree to these Terms should not register, publish Content, or use the System.
